Does anyone know if gaming is still banned on Chaturbate? I've seen a few larger streamers play games while camming and see no problem but smaller streamers get banned . @punker barbie

It would be great if there was a publicly viewable TOS stating the rules on it, if you could point us to that, actually.

Otherwise "contact support" sounds like rules will be made up on a case by case basis.
 
As the Chaturbate platform terms have always indicated, independent broadcasters are never allowed to stream or post content that violates any third party’s intellectual property rights, which includes footage from virtually all video games. With that said, an independent broadcaster may stream video game play footage during their live show if they have been granted the right by the game developer to capture and publish game play content. Anyone who wishes to stream video game play footage should carefully review the terms of use for any game they intend to stream and fully understand the game developer’s policies on publishing game play videos, which policies frequently prohibit use in connection with sexually explicit contexts.
 
Does that also mean that every Chaturbate model violates the terms when they play non royalty free music then??? 🤔

When people are streaming gameplay with commentary (which is what basically ALL cam models/Twitch/YouTube/Mixer/Etc streamers do) there's a "fair use" clause that allows them to do so. (Spoiler alert: that's how Twitch and all those other stream sites operate.)

There is still the chance that the owner of the copyright can send in a DMCA about the content being used, which is highly unlikely because video game companies seem to embrace this exposure as positive, but simply take the content down at that point, there's no risk in hosting it to begin with. And when it's LIVE streaming, the chances are super small.

CB has always aired so far on the side of caution that it dissuades its streamers from being creative and trying new things. It's a hindrance to the performers.

But that's fine. That's why MFC will always be superior in terms of creator freedom with what they stream.

I had my stream suspended when I was creating 3d models and doing graphics, can someone explain how that works because I don't get it since I own the copyright on the things I make, if that's a mistake then am I good to do 3d modeling, graphics and video editing while I'm on stream?

Which all the rules that arnt in the tos it makes it hard for models to know what is and isn't allowed. By default if something isn't covered in the tos then I would assume it's allowed on cam, there shouldn't be in written rules that you find out about due to bans.

Is there a link you can provide us with that has all of the rules for broadcasting on cb?

With something like that in mind, some not long time ago, I asked a support if I could stream a sexual hentai novel game, and if not — if there is anything that I still can do to be able to stream it anyway... And I got a respond as a bold "No" to everything — that I can't stream that game, and I can't do anything to be able to stream any games...

Is there anything else against streaming games? Because I don't see how and why a porn game could forbid you from sexually explicit streaming... ^^;

Idk what about if the game by itself breaks some intellectual things, but the game that I've asked is selling on steam for quite a while...

I think Cb really miss some gaming... What if there could be, at least, a whitelist of games that you are ok to stream?..

Can we at least be clear on whether you’re allowed to play a game as long as it’s not visible on stream? For example, you’re holding a controller playing a game, but the TV is hidden from the camera so no one sees any actual footage. I always see this type of stream on CB and just assumed it was ok.

In the defense of CB. All those sites currently have issues regarding people that false claim DMCA takedowns to 'troll' streamers. The other major difference between mainstream content sites vs camsites is by nature camsites don't reveal legal names for takedown challenges like the mainstream sites do. DMCA are LEGAL things at the end of the day. Sony and Nintendo have no issue putting their names on the documents but a model to claim 'fair use' in a court would have to announce their real name to the world. CB already has issue with false reporting auto-banning models left and right. MFC taking more risk of 'fair use' doesn't mean it's a good decision either.

I have no clue what MFC does if a good faith DMCA takedown is sent to them or what happens to the model as a result. I'm pretty sure if MFC ever gets in enough trouble over it they'll restrict their policy as well. You're assuming the reason they haven't done so is because they believe in content rights over that they haven't encountered a significant enough legal hurdle regarding copyrighted material.

Good question...I would assume that CB wants to guard against the possibility of a specific gaming company coming after them legally...but if you’re playing the video off cam, how would anybody know what exactly you’re playing, and thus no game company could claim it’s their game in the first place, unless the audio is playing too? So...probably allowed?
Though users would inevitably ask what game you’re playing and what are you gonna do, evade that question all night?
