im a new model on chaturbate and id like to start doing skype shows, with payment id only let them tip online 1st, but im not sure about the legal issues of what they can do with the recordings of my show? should i add a watermark on my skype shows? who has the legal rights to my shows? if people post it online can i get DMCA to take it down even if their watermark isnt on there?
 
Even though Skype is technically just a video chat platform, I'm pretty sure copyright to what you broadcast would default to you. If you want to make it clear, I'd watermark (c) maya77 or whatever. Technically that's not quite right unless maya77 is a registered LLC, but at least the intent is crystal clear. DMCA is a law, the Digital Millennium Copyright Act, which requires that sites take down content on receipt of a notice by the copyright owner or their agent. DMCA.com one of many companies offering services as an agent. That logo is part of their shtick and nothing to do with the law. You have the right to have content taken down regardless of logo.

Note also that you should not include your legal name or address in any DMCA notices you might file for yourself. The content of the notice is not considered copyrighted or confidential, and many companies (e.g. Google) publish the notices after they act on them.

No one has the legal rights to your show but you, bb. Recording without consent is generally uncool.

If you are that worried, use ManyCam and add a watermark. I've been in the biz five years and Skype recordings are the least of my worries in terms of piracy. A watermark will, at least, help you recoup the views/ad revshare from any videos that got pirated and will help with takedowns. Read through the stickies here, there are tons of good info on model privacy.

I do recommend using a VPN so they can't futz with your IP address. I've been quite happy with Private Internet Access.

As far as I know neither have I. Skype tends to be a more premium experience and rarely does a guy want to pay good money for a 1 on 1 show then record and share w/others. A lot of times I can even offer to record the show myself and charge an additional fee. A lot of the capped shows you see are models who do public shows or group shows where guys pay a smaller per/min fee.

To be legal about it. Unless the skype was paid through a service with an actual terms of service that supersedes (skyprivates, manyvids) It falls under telco rules that both parties have EQUAL footing. Which means neither party may use the video without the other's consent (in California both parties are protected by the revenge porn law).

However if a member is recording a skype or any one on one show they are usually doing it for their own personal records not for distribution. You biggest concern when it comes to social sites like CB and MFC are public room feed rips.

tl;dr sharing a skype session can be considered a felony by either party under normal situations. If the content of the session is understood to be 'intimate'.

Exactly. If anything cheeper the show, the more likely it will be capped.

That's very interesting! I hadn't thought about a Skype show falling under the same distribution rules as, for example, a telephone call, but that makes sense. I assume that since you can hear both people's voices during a phone call, you can't distribute that audio without both people's permission.

Do you think that applies if only one side can be heard/seen? Obviously if a guy takes a video of me, he can't legally post it without my permission. But if I record myself during the show, and his video and audio don't appear at all, would there be any reason I couldn't distribute my own likeness?
