Hi,

@punker barbie ,i opened ticket 6 days ago and i still didnt receive reply so i decided to escalate it here,my CB username is: smart4two , and i have a few questions about dac7 report that you will send in upcoming weeks to EU tax authorities,i will copy and paste my ticket here, but to make it short i need human to explain me what will be sent so that i know what i need to report and when it will be sent so that i know how much time i have to make my tax report,my ticket is :

" i received email from chaturbate that you will send dac7 reports for 2023,2024,2025 and i guess 2026 at the end of the year, okay, now here comes my problem,i was not cam model,i was affiliate of chaturbate,i was referring new users to chaturbate under rev share model,in 2023 you have paid me around 200 USD on my external bank account, after that you have asked me to complete kyc to receive future payments and i have refused, after that you have restricted my account,i still had access to my affiliate panel but i was unable to cashout,my referrals that i referred to chaturbate have continued to spend money and i assume that money was accumulating in my account,my affiliate stats show around 2200 USD accumulated from 2023 till today, can you tell me what will you send via dac7 report as my earnings, will you send amount that was paid out to my external bank account,or you will send all accumulated amount that i have received while my account was restricted, and one more question,if you send via dac7 amount that i have accumulated and if i verify my account with kyc and decide to cashout this money to my external bank account next year, will this money be sent again via dac7 as my 2027 earnings, because if it will i will have to pay taxes two times for it,could you please clarify this, thank you. hey did you read support section? Chaturbate is really cool with this - before sending reports, we all will get first PDF files with information what exactly will be sent and of what they wrote i understood that they will also give us time to verify those informations before reports will be sent . im on few pages and chaturbate is first one which will give us those files first to check infos and compare with our calculations.

my understanding is that DAC7 does NOT apply to affiliate commissions. it only applies to those who sell personal services and/or goods, and affiliate commissions do not fall into either category

a Euro-based aff I know received an email from cb that stated "Please note that affiliate-only earnings are currently excluded from DAC7 reporting"

as such, DAC7 won't be a concern for you. what is odd though is that now, ANYONE, in any nation, who wishes to be paid needs to go through an updated KYC that involves signing the broadcaster agreement. so all the affs like me who have zero intention of performing on cb are now 'creators' there. really bizarre, but it's the way cb is choosing to do things so, lol, shrug

my guess is that they've chosen this 'all affs are creators now' approach because so many cb performers are affs as well. as in, under DAC7 a Euro-based performer/aff would have their performer income declared, but not their aff income. that's just a guess though

OP, why not just bite the bullet and do your KYC? I know you didn't ask for advice on that but cb isn't going to change their policy, if you want those funds at any point you're gonna have to provide your ID, etc

either way though, DAC7 doesn't apply to cb aff income

I was also under that impression but in email they sent to me it says:

" We are contacting you today to provide an important update regarding EU tax reporting requirements (DAC7) that impact your account.

Our records show earnings on the following accounts: smart4two " ,

so based on that i concluded that my earnings will also be sent

and regarding KYC,when they asked me to do KYC in 2023 i refused and told them that they can close my aff account and that i forfeit my future earnings,so i never planned to do KYC or to withdraw

I got the same mass email from them.
I never streamed or sold anything on CB.
I just received from a model tokens and cashed that out. So I never sold any personal service or goods... yet I still got that email. Also I am not in the EU since 2023 and asked support many times about it... they told me nothing gets reported and they dont want any documents from me. Now they sended me that email. It feels like they have much intern trouble and dont know what they should do now. Idk

I never dont know when to trust chat Gemini or not, but why not to ask in the meantime of waiting for official response. This is what it told me:

Is a Chaturbate Affiliate / Revshare user subject to DAC7 reporting?
Yes, absolutely.
Many people wrongly assume that the EU's DAC7 directive only applies to "direct sales of goods or adult services" (like performing on webcam, selling clothes, or renting an apartment).
In reality, DAC7 defines "Relevant Activity" much more broadly:
Under DAC7, any service provided for remuneration to users or to the digital platform itself is subject to reporting.
Promoting the platform, referring new users, and receiving a commission (Revshare) is legally considered a marketing/advertising service provided to Chaturbate.
Since the payout amount exceeds the reporting thresholds (thresholds mainly apply to the sale of physical goods up to 30 transactions / €2,000, whereas for services there is practically no lower threshold protecting you), the platform is legally obligated to report these earnings.
Why do some affiliates think DAC7 doesn't apply to them?
This misunderstanding usually comes from two common misconceptions:
"I never submitted ID or completed KYC in the past":
The fact that someone opened an affiliate account years ago without submitting an ID does not mean Chaturbate won't report them. DAC7 forces platforms to collect tax details from all partners who earned money. If an affiliate ignores the emails and refuses to complete the identity verification, Chaturbate is legally required to freeze payouts and suspend the account. Furthermore, if Chaturbate already has payment details on file (like the bank account or payment processor where the $2,200 was sent), they will report whatever data they hold.
Confusing adult webcam services with marketing services:
An affiliate might think: "I wasn't a cam model, so I'm not a seller." For tax authorities and DAC7, it makes no difference whether you perform on camera or drive web traffic via referral links. The legal fact remains: you received money from an online platform in exchange for an online service (digital marketing).
Summary
Believing that an Affiliate / Revshare profile exempts someone from DAC7 is a mistake. In the eyes of tax authorities, affiliate marketing is a standard taxable advertising service

And ChatGPT:

I think Gemini’s answer is too categorical and may be based on a misunderstanding of DAC7.

The key point is that not every taxable income or payment received from an online platform automatically falls under DAC7 reporting.

DAC7 covers specific categories of “Relevant Activities”, including personal services, the sale of goods, rental of immovable property, and rental of means of transport.

Affiliate marketing is not explicitly listed as a Relevant Activity.

More importantly, DAC7 defines a “Personal Service” as work performed on a time or task basis, at the request of a user, and facilitated through a platform.

A typical Chaturbate affiliate simply promotes the website through referral links and receives a Revshare commission. They are not performing webcam services, providing services to Chaturbate users on request, or being connected with customers through the platform to perform specific tasks.

In this situation, the affiliate is essentially providing advertising or traffic acquisition services to Chaturbate itself. That is quite different from being a seller performing a Relevant Activity through the platform.

Gemini also incorrectly refers to the €2,000 threshold. That threshold concerns the exclusion for certain sellers of goods. It does not mean that any affiliate earning more than €2,000 automatically becomes reportable under DAC7.

Of course, Chaturbate may still request KYC or tax information for other compliance reasons. However, collecting such information does not automatically mean that affiliate earnings are reportable under DAC7.

My conclusion: There are strong legal arguments that ordinary Affiliate / Revshare earnings from referral traffic alone fall outside the scope of DAC7. However, only Chaturbate can confirm how it classifies and reports these accounts in practice.

Here’s Gemini’s current view after reading ChatGPT’s response:

My stance now: Your counterpart is right, and the initial position (as well as my previous response) was overly hasty and simplified.
If you look at the situation strictly from a legal perspective, your opponent's arguments hold more weight. Here is why:
1. The Letter of the Law (DAC7 Text)
• DAC7 does not cover everything indiscriminately. The directive was created to regulate the gig and platform economy (Airbnb, Uber, Etsy, Vinted, OnlyFans, etc.).
• The concept of "Personal Services": In the DAC7 framework, personal services refer to work performed at the request of a specific user or platform on a time- or task-based basis.
• Affiliate / Revshare: Driving traffic via a referral link is B2B marketing/advertising, not fulfilling an individual task for a user. A typical affiliate is not providing a "personal service" to a Chaturbate client through the platform.
2. The €2,000 Threshold Error
Your opponent is completely correct to point out the mistake in the previous conclusion. The €2,000 / 30 transactions threshold in DAC7 is specified exclusively for sellers of physical goods, ensuring platforms are not required to report on individuals selling their second-hand personal items. Extrapolating this threshold to marketing or services as an argument for why an affiliate "definitely falls under DAC7" is incorrect.
3. KYC Does Not Equal DAC7
The fact that a platform requests identity verification (passport, Tax ID, address) does not mean this data automatically gets reported to tax authorities under DAC7. Platforms collect KYC for dozens of other reasons:
• Anti-Money Laundering (AML) compliance
• Requirements from acquiring banks and payment processors
• US tax reporting compliance (W-8BEN / W-9 forms, since Chaturbate is a US-based company)
Final Position
1. Legal Qualification: Standard referral marketing (Revshare) is highly likely outside the scope of DAC7, as it does not constitute a "Relevant Activity" under the EU directive's definition.
2. Platform Practice: In the real world, what matters most is how Chaturbate’s internal legal department interprets the directive. There are cases where platforms "play it safe" out of fear of multi-million-euro EU fines and report data on everyone receiving payouts. However, that comes down to a specific company's internal policy rather than a statutory requirement.
Verdict: Your counterpart provided an exceptionally well-informed and accurate legal breakdown.

And here is the official response from Chaturbate Support:

“Please note that affiliate-only earnings are currently excluded from DAC7 reporting. However, reporting requirements may change in the future. If there are any changes that affect these earnings, we will provide you with updated information.”
